1. Publisher and purpose of the Terms
The Tavern is a party games app for iPhone and Android. It is published by Ascent Studio App, a French SAS with a share capital of €1,000, registered with the Lyon Trade and Companies Register (RCS) under number 993 734 383 ("we").
These Terms of Use (the "Terms") set out the rules that apply between you and us when you use The Tavern. By using the app, you accept these Terms. If you do not accept them, you must not use the app.
Contact: contact@ascentstudio.app.
2. Minimum age: 18
The Tavern is reserved for adults aged 18 or over. Some content is suggestive ("Naughty" mode) and many challenges are designed for evenings among adults.
By using the app, you confirm that you are at least 18 years old. If you play in a group, ensure that all the players are adults.
3. Description of the app
The Tavern brings together several party games: questions, challenges, votes, team games and tests, with different modes and themes.
To play, you enter the players' first names and, for some games or modes, their gender and who they are attracted to. This information is used solely to adapt the cards and remains on your phone (see the Privacy Policy).
The app does not require an account and contains no advertising.
The content changes over time: we may add, modify or remove games, modes or cards, in particular to improve the app or to correct an error.
4. Free version and VIP subscription
Part of the app is free. The other games, modes and content are reserved for VIP members, who hold a paid subscription.
The VIP subscription:
- is purchased in the app, through the App Store (Apple) or Google Play (Google), which collect the payment;
- renews automatically at the end of each period, for as long as it has not been cancelled;
- may start with a free trial, depending on the plan offered.
The length of the free trial, the price and the period are those shown in the app and on the App Store or Google Play at the time of subscription. They may vary depending on your country, current offers (for example during a Happy Hour) or the version of the app.
If you do not cancel before the end of the free trial, the paid subscription starts and its price is charged by Apple or Google.
You may cancel at any time from your Apple or Google account settings. Cancellation takes effect at the end of the current period, until which you retain VIP access. Deleting the app does not cancel the subscription.
The procedures (cancelling, requesting a refund, restoring your purchases, changing phone) are set out on the "Subscriptions and refunds" page.
5. Responsible play
When the app is opened, the following message is displayed: "Drinking too much is dangerous to your health. No challenge is compulsory."
In particular:
- No challenge is compulsory. Each player may decline a question or a challenge without having to give a reason.
- Play in moderation, respecting your own limits and those of others.
- Each player is responsible for their own actions during the game. The cards are game suggestions, not instructions.
- Never play while driving. If you have consumed alcohol during the evening, do not drive.
- Respect everyone's consent, in particular with suggestive content. A refusal is not open to discussion.
- Do not do anything dangerous or illegal, or anything that could injure someone or cause damage.
- Respect the other players' privacy: do not share their answers or their first names without their consent.
6. Share links
Certain results can be shared from the app: the Purity Test, the Battle Royale recap or the "My stats" page. The app then creates a link to ascentstudio.app, and you choose who you send it to.
Please note:
- The result is contained in the link itself. The website does not store anything.
- Anyone who has the link can view the page, and the link can be forwarded.
- The Battle Royale link contains the players' first names, readable in plain text. It must therefore only be shared with the consent of the players concerned.
- The Purity Test link contains your scores by theme, without your first name.
- Once sent, a link can no longer be withdrawn, either by you or by us. Messaging apps may also keep a preview of the page.
You can also share the image of a result or save it to your photos. The app only does so at your request.
7. Intellectual property
The app, its games, cards, text, images, logo, trademarks ("The Tavern" ("La Taverne"), "Ascent Studio App") and code belong to us or are used with permission.
We grant you the right to use the app for personal, non-commercial purposes, on your devices, provided that you comply with these Terms. This right is neither exclusive nor transferable.
The following are prohibited:
- copying, reselling or republishing the app's cards and content, in whole or in part;
- decompiling, modifying or circumventing the app, in particular to access VIP content without a subscription;
- using the app in a commercial setting (bar, paid event, sponsored video…) without our written consent.
Apple's terms (the App Store End User Licence Agreement) and Google Play's terms also apply, in addition to these Terms.
8. Availability and updates
We do our best to ensure that the app works properly, without being able to guarantee that it will be available at all times, free of errors and interruptions.
Some features require an internet connection (for example the "Would You Rather" percentages, the counter of parties going on now or current offers). Without a connection, they may not be displayed.
The app is updated regularly. Some updates may be required to continue using it. If we permanently withdraw the app, we will inform you in advance wherever possible, and no subscription will be renewed for a period that you would be unable to use.
9. Liability
We are liable for our commitments under the conditions provided for by law, in particular for the conformity of digital content (Articles L.224-25-12 et seq. of the French Consumer Code).
We are not responsible for:
- the use that players make of the app, or what they decide to do during a game;
- damage caused by failure to comply with these Terms, in particular section 5;
- problems related to your phone, your connection or Apple's and Google's services;
- the use that recipients make of a link you have shared.
Nothing in these Terms limits your rights as a consumer, or our liability where the law prohibits it.
10. Personal data
We collect as little data as possible. Its processing is described in the Privacy Policy, available on ascentstudio.app and from the app's settings.
11. Changes to the Terms
We may amend these Terms, for example when the app evolves or the law changes. The date of the latest update appears at the top of the page.
In the event of a significant change affecting you, we will inform you in the app before it takes effect. If you do not agree, you may stop using the app and cancel your subscription.
12. Governing law and disputes
These Terms are governed by French law.
If a difficulty arises, write to us first at contact@ascentstudio.app: we will seek an amicable solution.
Failing agreement, the dispute will be brought before the competent courts in accordance with the applicable legal rules. If you are a consumer, you may bring proceedings before the court of the place where you resided at the time of the purchase or at the time of the event giving rise to the damage.
If you reside in another European Union country, you also retain the protection of the mandatory rules of your country.
13. Language
These Terms may be translated into other languages. In the event of any difference between a translation and the French version, the French version prevails.
14. Right of withdrawal
You have 14 days from the date of subscription to withdraw, without having to give any reason (Article L.221-18 of the French Consumer Code). A model withdrawal form is available.
As payment is handled by Apple or Google, the request must be made to them (see the "Subscriptions and refunds" page). You may also write to us at contact@ascentstudio.app: we will assist you with this procedure.
Refunds are processed by Apple or Google, under their own rules. We cannot ourselves refund a purchase made on the App Store.
